Terms & Conditions
1. A "Bidders
Card" is required for all sales . Bidder's Cards will only
be issued upon production of adequate identification IE.
driver's license etc.
2. The
highest acknowledged bidder shall purchase , subject to a
reserve, if any. A: The highest bidder for a passed in lot
has the exclusive right to negotiate until the end of the
auction day or any other time specified by the Auctioneer.
3. A 12.5%
Buyers Premium will be added to the purchase price of all
lots sold. ( Buyers
Premium is GST Inclusive )
4.
Payment :

Attending Bidders :
Payment shall be strictly Cash, Bank Cheque ,
Personal cheque by arrangement , Money Order , Bank
Transfer .
Payment must be received no later than the 1 days after
the auction . No goods in part or whole may be collect until full
payment has been made .Open times to be advised .
Commission bids
must be collected by 12.30 am Sunday ( Day
after auction ) or by other arrangement.

Interstate Bidders : Payment shall be strictly Bank Cheque, Personal cheque ( allow 7 days
to clear ) , Money Order , Bank Transfer or cash
sent by registered post . Payment must be received
within 3 days of the auction's conclusion .

Overseas Bidders :
Payment by
Paypal . Paypal will attract a surcharge of 4% added
to the total amount payable including shipping if
required. This charge is to help cover paypal
charges ) We can calculate postage for you on
successful small lots won , so payment may be made
all in one. Post is via Australia Post . For
further information please contact auctioneer .
Payment must be received within 3 days of the
auctions conclusion .

5. All lots
sold will include GST, if applicable in the hammer price, unless
otherwise stated by the auctioneer
prior to the start of the auction .
6. Successful
bidders are not permitted to re-sell or subdivide lots in
the sale area.
7. The
Auctioneer may demand a percentage of the purchase price as
a deposit and may resubmit the lot if this deposit is not
paid immediately.
8. The
Auctioneer has the sole right to determine the recognition
of bids (including the final bid) and any other dispute.
9. If default
is made in respect of any lot the Auctioneer has the
discretion to offer the lot for resale at any time.
Defaulting buyers shall be liable for any loss , including
costs incurred by the seller or the Auctioneer by reason of
that default. Legal proceedings for recovery of that loss
may be issued against the defaulter.
10. Cigarettes
and/or alcohol will not be sold to minors due to State
and/or Federal legislation.
Cigarettes and/or alcohol are sold
as is
. Condition of such items is unknown . The buyer takes full
responsibility for for any sickness , loss , death or
anything else that may arise from use or consumption of the
above mentioned items .
11. Written
absentee Bids will be accepted by the Auctioneer if
lodged no later than 15 minutes prior to the start of the
auction. Interstate
and overseas bidders must lodge bids 12 Hours prior to the
start of the auction . The Auctioneer will announce prior to
each lot if any absentee bids have been received. A
successful absentee bid will bind the bidder as purchaser to
all of these conditions of sale.
12. No bid
shall be withdrawn. The Auctioneer may, without giving any
reason therefore, refuse to accept the bid of any person or
withdraw any lot from the sale.
13. Lots are
sold as uninsured and are at the risk of the purchaser from
the instant of delivery.
14. Loading
and removal of lots is the sole responsibility of the
purchaser .
15. A official
receipt is required for collection of Lots. All
collection of goods must be supervised by the
Auctioneer or auctioneers staff . Delivery is not to be taken without
a representative or auctioneers being present at the
time.
16. All
items sold are as inspected . Barry Mills auctions & staff
take no responsibility for any omissions or errors verbal or
written or otherwise in respect to any item in any auction .
If there is any fault or defect in any lot Barry Mills
auctions & staff offer no warranty whatsoever. All lots
having been available for inspection prior to the auctions
start , no allowance or refund will be made nor may any
buyer reject a lot because of alleged misrepresentation. All lots
are sold subject to all faults (if any).
17. No
electrical items have been tested prior to auction. All electrical items
must be tested by a certified electrician before use.

responsibility for loss or damage to any property, personal
injury claims caused by or any other claims resulting from
use or handling any electriacl
item prior to being sold or after it sale
.
18. No
responsibility or liability is accepted for any loss or
damage to goods or personal injury by accident or any
other means . All items are sold as examined prior to
auction . No warranty is offered in any form. The Auctioneer's decision shall be final
and binding.
19.
To
resolve any error, dispute or default the Auctioneer has the
discretion to resubmit a lot at any time during the auction
or thereafter .
20. All items
must be paid for and collected at a time arranged by and
suitable to the auctioneer.
